When people hear “family lawyer”, they picture a divorce. That’s only one corner of it. Some of the most important family work happens quietly, long before anyone is in court: a will, a guardianship arrangement, a parenting agreement.
Our family lawyers in Dubai handle a wide range: marriage contracts, separation, custody and visitation, child support, guardianship, wills, and inheritance. A good overview is in what family law covers in Dubai.
This is where families feel the most pressure. Courts focus on the child’s best interests, and the rules on who holds custody, and until what age, have been updated in recent years. Because those changes keep coming, check the current position rather than relying on what a friend went through. We’ve written about the 2025 changes extending custody rights for mothers and a father’s sole custody.
Travel is another trap. Taking a child out of the country without the right authorisation can lead to serious penalties, as covered in fines for unauthorised travel with minors. It’s worth sorting out in writing before the school holidays, not at the airport.
If you live in Dubai and don’t have a will, local succession rules may apply to your estate in ways you never intended. For non-Muslim residents, you can write a will and register it, for example through the Dubai Courts or the DIFC Wills Service, so your wishes about assets and guardianship of your children are followed.
Our wills and guardianship team can draft one, and our article on wills for non-Muslim foreigners in the UAE explains the options.
If something happens to both parents, who looks after the children, and who manages their money? Without a plan, the court decides. A guardianship arrangement lets you decide.
Sometimes family work does lead to the courtroom. We cover that in detail in our guide on choosing a divorce lawyer in Dubai, and on the alternative of judicial separation.
The last one matters more than people expect. Family cases are personal, and you’ll be sharing things you haven’t told anyone.
