Labour Lawyer in Dubai: How a Labour Claim Really Moves From MOHRE to Court

Articles

If your salary is three months late or you’ve just been dismissed with no explanation, the last thing you want is a lecture on legislation. You want to know what happens next. So let’s walk through it.

The starting point is knowing your rights, which we cover in workplace rights every UAE employee should know. This post is about the process.

Step 1: Gather your paper before you do anything else

Before you confront anyone, collect your contract, offer letter, recent payslips, bank statements showing salary credits, your labour card, and any messages or emails about the issue. If you’ve been terminated, keep the letter. Don’t sign a resignation letter or a “settlement” you haven’t read. We see that mistake more often than any other.

Step 2: The complaint through MOHRE

Most labour disputes start with the Ministry of Human Resources and Emiratisation. You file a complaint, and the ministry calls both sides in and tries to settle the matter within a short window, roughly two weeks. Plenty of cases end here. Recent changes also give the ministry the power to decide lower-value claims itself, which we explained in changes to the labour complaint process.

Step 3: The labour court

If there’s no settlement, the file is referred to court. This is the point where a labour lawyer in Dubai matters most, because hearings are about documents and legal arguments, not who sounds more convincing. Our labour lawyers prepare the claim, respond to the employer’s defence and press for enforcement once judgment comes.

One warning on time: labour claims generally have to be brought within a year of the right arising. Waiting “to see if things improve” can quietly cost you the claim.

What can you actually claim?

  • Unpaid wages and overtime
  • End-of-service gratuity. Broadly, that’s 21 days’ basic wage for each of the first five years and 30 days for each year after, capped at two years’ total pay
  • Notice pay, where notice wasn’t given
  • Compensation for arbitrary dismissal, which can be up to three months’ wages
  • Annual leave you never took

Your actual figures depend on your contract, so treat those as the outline, not a calculation. For termination in particular, read what you need to know about employee termination in the UAE and taking legal action for wrongful termination.

Employers need a lawyer too

This isn’t only an employee story. Employers face complaints over notice, probation, final settlements and contract terms. A work lawyer in Dubai can fix the paperwork before it becomes a dispute, and defend you properly when it does. If you’re an HR manager, the same applies: our lawyers in Dubai for labour law advise both sides.
